Unanswered Questions from the Presentation:

  • What costs can you apply the tax credits. (ie equipment, labor, interconnection costs, future replacement costs)
    • It depends on which technology but in general it is Design, Install and Equipment.
  • What is the current and near term ceiling to Section 179 Bonus Depreciation? $1.040M?
    • 179 and 179D are completely different incentives.  179D is the area we are expert in and it has no limit.  I believe 179 limit is $1 Million.  I'm unsure if it adjusts to inflation.
  • What version of ASHRAE 90.1 does EPAct 179D require for the energy modeling analysis?
    • ASHRAE 90.1 2007 until 12/31/2026 and then ASHRAE 90.1 2019.
  • There are obviously architects and engineers on projects. Do they have to agree on who applies?  
    • We always recommend sharing, but either are both are eligible parties to take the tax deduction.
  • Does your firm help with actually filing the credits for not-for-profit agencies (school districts, etc.)?  
    • That has been an issue with early projects is the districts aren't sure how to claim this.  We plan on doing just that.  We are staying on top of all the guidance to ensure we can assist when filing time comes around.  Most likely you file in 2024 for 2023 placed in service projects.
  • How does your firm get paid?  Contingency or hourly?  
    • Typically we review projects on a complimentary basis and submit a fixed fee.
